In an ideal world, all of the difficult decisions that need to be made when a relationship breaks down could be made by the separating couple, quickly and easily between themselves without the need for professional services.

More often than not, however, the conflict and emotion involved in the breakdown of a relationship frustrates discussion and decision making and couples require professional support to navigate the challenges they face.

EAG Family Mediation offers a range professional services to guide you through that decision-making process:

Initial Assessment Meeting
Sometimes referred to as a MIAM (Mediation Information and Assessment Meeting) this will last around 60 minutes and is usually conducted online. It is an opportunity to talk to your mediator confidentially about your circumstances and about whether mediation would be a useful process for you.
The government now requires most divorcing and separating couples in England and Wales to show that at least one of them has attended a MIAM before they are allowed to use the Court process to resolve their issues relating to children or finances. This is because the Family Courts in England and Wales are stretched beyond limits, often with matters that should not need to be dealt with in Court by a Judge. These rules exist to divert cases away from the courts where it is appropriate to do so.
If, following your assessment meeting, you do not wish to proceed with mediation, EAG Family Mediation can arrange for your court application forms to be signed confirming that mediation has been considered.
Child and Parenting Mediation
Both parents are responsible for looking after their children, even after divorce or separation. They have to work out between themselves what arrangements should be made for their children immediately and in the future. Mediation is effective in helping parents decide things such as where children should live and how they will share their time. Communication is a key factor in this process and mediation can assist couples with communication during the meetings themselves and also with managing communication for parenting purposes into the future.
The Family Mediation Council guidance states that children over 10 years of age, and sometimes younger, should be offered the opportunity to talk to a specially trained mediator and have their voices heard during the mediation process. EAG Family Mediation works closely with other consultant family mediators, specially trained in Child Inclusive Mediation and will explore this option with you if appropriate.
Financial Mediation
When relationships break down, difficult decisions need to be made about future financial arrangements and what to do about matters such as the family home, other property and assets, future income, savings and pensions.
EAG Family Mediation can help you to work through this financial minefield in order to find solutions that work for the whole family.
Joint Financial Statement
For a financial mediation, you will be required to provide information and documentation to your mediator setting out your financial position which will be summarised by your mediator in a Financial Statement. Not only will this be used for discussions during mediation, but it can be provided to solicitors to support the drafting of a consent order or to the court if legal proceedings follow.
Summary of Proposals
At the conclusion of the mediation, the mediator can prepare a formal and confidential summary of the mediation process and any proposals made. It is a privileged document which means it can not be produced in court or relied upon in legal proceedings but it may be provided to legal advisers.
Please note, EAG Family Mediation is able to offer both on line mediations or in person mediations. In person mediations are held in Winnington Hall in Cheshire CW8 4DU, a beautiful listed building easily accessible from both the M6 and M56.
